Cottage Food Law – Nebraska Regional Food Systems Initiative – Nebraska Extension

In 2019, Nebraska passed a bill (LB 304) allowing individuals to sell homemade foods already authorized for sale at farmers’ markets directly to consumers at the producer’s home, fairs, festivals, other public events or online for pick-up or delivery—all within the state of Nebraska.

As of September 1, 2019, a person may prepare and sell food that is:

NOT Time/Temperature Control for Safety Food directly to the consumer

At a public event

For pick up or delivery

In the mail

Without obtaining a food establishment permit
